The second release becomes effective on 1 March 2023.

To make sure that the security and safety of the EU is maintained across the EU external border it is necessary to make an adjustment in the coordinated and gradual approach for deployment of the ICS2 Release 2, described in the "Transition from ICS2 Release 1 to Release 2 strategy". The change affects the air carriers operating direct flights from third countries into Member States which have been granted the derogation to connect to ICS2 Release 2 central system until 30 June 2023 (Austria, Belgium, Denmark, Estonia, France, Greece, Croatia, Luxemburg, Netherlands, Poland, Romania, Sweden). How?

Operators have to complete the ENS dataset for all goods in air transport.

More precisely:
All goods transported by air in postal, express and general cargo consignments will be subject, in addition to pre-loading filing requirements, to complete pre-arrival ENS data requirements.

Important to note that new data requirements will enter into force on 1 March 2023, with the launch of ICS2 Release 2, as set by the Annex B of the Union Customs Code Implementing Act & Delegating Act. Declarants should pay particular attention to certain new data requirements. Notably, they will have a legal obligation to provide in the ENS particulars:

  • the HS commodity code (6 digit) of the goods of a commercial nature (i.e. B2B and B2C): The Combined Nomenclature
  • the EORI of the consignee established in the EU, if such number was assigned to this party. Parties need to make their EORI number available to the ENS declarant. The EORI number can be validated at the following webservice of the EU Commission, in order to be sure that the data is correct: EOS What's new (europa.eu).

Adequate descriptions of goods in a plain language and precise enough for the customs authorities to be able to identify the goods, is also very important. Please consult the ‘Unacceptable goods descriptions guidance’ available at Import Control System 2 - Release 1 (europa.eu).

It is thus very important that declarants ensure that all required information is obtained from their customers.

The EU customs authorities may reject ENS declarations in the case of lack of complete data or issue risk mitigating referrals in the pre-arrival phase requesting the declarant to provide the necessary data, for example in the case data will not be accurate. This may create delays in processing of the ENS upon the arrival of the consignments and in the entry process, as the risk mitigating referrals must be answered and requested information must be provided before the risk assessment can resume. Customs may also decide to impose administrative sanctions for non-compliance with data requirements.

    Die zweite Phase des EU-Zollprogramms zur Warenvoranmeldung zur Sicherheit und Gefahrenabwehr – Import Control System 2 (ICS2) – tritt am 1. März 2023 in Kraft. Dies betrifft alle per Luftfracht transportierten Waren. Wirtschaftsbeteiligte müssen über eine sogenannte Entry Summary Declaration (ENS) Daten für die Sicherheit und Gefahrenabwehr an ICS2 übermitteln. Deswegen müssen Sie ihre IT-Systeme rechtzeitig entsprechend vorbereiten.

  • Préparation technique ICS2

    La deuxième phase du système d’information des douanes pour la gestion des risques relatifs à la sécurité et à la sûreté avant l’arrivée sur le territoire de l’Union européenne – Système de contrôle des Importations/Import Control System 2 (ICS2) – sera mise en service le 1er mars 2023. Elle concerne tous les biens transportés par voie aérienne. Les opérateurs économiques (OE) devront se connecter à ICS2 et soumettre une déclaration sommaire d’entrée électronique (DSE). Pour cela, vous devez effectuer plusieurs opérations afin que vos systèmes informatiques soient prêts dans les temps.

    Das Import Control System 2 (ICS2) ist das IT-System der EU, mit dem Daten zu allen Waren, die in die EU eingeführt werden, vor ihrer Ankunft mittels der Entry Summary Declaration (ENS) erfasst werden. Ab dem 1. März 2023 gelten für Wirtschaftsakteure, die an der Abfertigung, dem Versand und der Beförderung von Fracht-, Express- oder Postsendungen in oder durch die EU auf dem Luftweg beteiligt sind, neue Datenmeldepflichten für die Zollrisikobewertung vor dem Verladen und Eintreffen von Waren.

  • ICS2 Phase 2 : nouvelles exigences pour transporter des marchandises par voie aérienne vers ou via l’UE

    Le Système de contrôle des importations/Import Control System 2 (ICS2) est le système informatique créé par l’UE pour recueillir des données sur toutes les marchandises qui pénètrent dans l’UE avant leur arrivée, par le biais d’une déclaration sommaire d’entrée (DSE). À compter du 1er mars 2023, les opérateurs économiques impliqués dans la manutention, l’expédition et le transport de fret et d'envois express ou postaux vers ou via l'UE par voie aérienne devront se soumettre à de nouvelles exigences de déclaration des données dans le cadre de l’évaluation des risques douaniers avant le chargement et l’arrivée des marchandises.

In addition to filing pre-loading advance cargo information (PLACI) about the goods being transported to or via the EU by air, Economic Operators will need to file pre-arrival data in the ICS2 system through a complete electronic Entry Summary Declaration.

  • ICS2 Phase 2 Anforderungen für die Einreichung von Vorabdaten

    Die zweite Phase des Import Control System 2 (ICS2) der Europäischen Union tritt am 1. März 2023 in Kraft. Bislang waren für Waren, welche in oder durch den europäischen Luftraum befördert werden, nur Vorabinformationen vor dem Verladen notwendig (PLACI). Mit Phase 2 müssen Wirtschaftsbeteiligte jetzt auch eine vollständige elektronische Entry Summary Declaration (ENS) für Waren vor der Ankunft im Zielland einreichen. Dabei können Wirtschaftsbeteiligte entweder direkt die vollständige ENS einreichen oder aber die ENS in Teilen übermitteln (diese Teile können auch von mehr als einem Wirtschaftsbeteiligten eingereicht werden). Wichtig ist, dass am Ende alle für den Warentransport erforderlichen Daten eingereicht wurden.

  • ICS2 phase 2 Exigences en matière de déclaration de données avant arrivée

    La deuxième phase du Système de contrôle des Importations/Import Control System 2 (ICS2) de l’Union européenne démarrera le 1er mars 2023. Outre la déclaration des informations préalables sur le fret avant chargement (PLACI) pour les marchandises transportées vers ou via l’UE par voie aérienne, les opérateurs économiques (OE) doivent déposer les données avant arrivée dans le système ICS2 par le biais d’une déclaration sommaire d’entrée électronique (DSE) complète. Une DSE complète peut être constituée d’une seule déclaration DSE complète ou d’un ensemble de déclarations DSE partielles (envoyées par plusieurs OE) contenant, une fois réunies, toutes les données requises sur les marchandises acheminées dans l’UE par voie aérienne.
